1. Eligibility

To use our Services, you must:

  • Be at least 19 years old.
  • Be a resident of Canada with a valid Canadian delivery address.
  • Not be affiliated with law enforcement or regulatory agencies in any investigative capacity regarding our Services.

By creating an account and placing an order, you represent and warrant that you meet these eligibility requirements and that all information you provide is true and accurate.

2. Account Registration and Age Verification

  • To purchase from GasDank, you must create an account and complete age verification using government-issued ID (e.g., driver’s licence).
  • We may use third-party age-verification services.
  • You are responsible for maintaining the confidentiality of your login credentials and for any activities under your account.
  • We reserve the right to suspend or terminate accounts that we suspect are fraudulent, used in violation of these Terms, or do not pass age/eligibility checks.

3. Products and Information

GasDank sells cannabis and cannabis-related products for adult recreational use in Canada.

  • Product descriptions, images, prices and availability may change without notice.
  • We strive to provide accurate information but do not guarantee that product descriptions or other content are error-free.
  • Any information about effects, benefits or usage is not medical advice and should not replace consultation with a healthcare professional.

4. Pricing, Taxes and Promotions

  • All prices are shown in Canadian dollars (CAD).
  • GST/HST is included in our product prices unless otherwise stated.
  • We may run promotions, discounts and loyalty programs, which are subject to specific terms and may be changed or discontinued at any time.

5. Ordering and Payment

5.1 Placing an Order

To place an order, you must:

  1. Log into your GasDank account;
  2. Select eligible products and add them to your cart;
  3. Provide accurate shipping details (Canadian address only);
  4. Confirm the order and follow the payment instructions provided.

5.2 Payment Method – Interac e-Transfer

  • We currently accept Interac e-Transfer as the primary payment method.
  • Your order will remain “On Hold” until your e-Transfer is received and matched to your order (using the order number and correct security question/answer).
  • It may take up to 2 hours for the Interac e-Transfer to be processed by your bank and our payment system.
  • If payment is not received or cannot be matched within the specified time (typically 24 hours), your order may be cancelled automatically and you may need to place a new order.

We reserve the right to change accepted payment methods at any time.

6. Order Processing, Edits and Cancellations

  • Orders are processed after successful payment confirmation.
  • Once placed, you cannot edit an order yourself; to modify or cancel, you must contact our customer support.
  • Unpaid or unprocessed orders may automatically cancel after a set period (e.g., 72 hours).

We reserve the right to refuse or cancel any order, including in cases of suspected fraud, incorrect pricing or policy violations.

7. Shipping, Delivery and Risk of Loss

7.1 Same-Day GTA Delivery

We offer same-day weed delivery within parts of the Greater Toronto Area (GTA) under the conditions set out on our How To Order page, including:

  • Delivery time: typically 1–2 hours from confirmation during operating hours.
  • Working Hours:
    • Sunday–Wednesday: 8:00am–2:00am (last call 1:45am)
    • Thursday–Saturday: 8:00am–3:00am (last call 2:45am)
  • Minimum order and delivery fees (examples):
    • Within GTA/Mississauga: minimum $40 + $15 delivery fee or free delivery over $80
    • Brampton/Oakville/Durham/Vaughan: minimum $60 + $20 delivery fee or free delivery over $160

The exact fees, minimums and areas served are published and updated on our website. In case of discrepancy, the information on the How To Order page at the time of ordering will prevail.

7.2 Canada-Wide Mail Order

For mail order cannabis to Canadian addresses, we typically use Canada Post Xpresspost and/or Purolator:

  • Shipping cost: e.g., $25 for orders under a threshold (e.g., $150), with free shipping on qualifying orders (e.g., $150+).
  • Orders are usually shipped within 24 hours of being processed and paid.
  • Typical transit times are 1–3 business days, with remote/rural locations taking up to 5 business days.

We may update carriers, rates and thresholds; the current terms on the Site at checkout apply.

7.3 Packaging and Discretion

  • All orders are shipped discreetly, in smell-proof, vacuum-sealed packaging with no cannabis-related indications on the exterior.

7.4 Shipping Insurance and High-Theft Areas

We may provide optional shipping insurance at checkout:

  • If selected (or automatically applied for high-value orders), your package is covered against postal service failures.
  • If you do not receive your package within a reasonable time after the expected delivery date, contact us so we can initiate a trace with the carrier.
  • Certain regions (e.g., Nunavut, Northern Quebec, Northwest Territories) are considered high-theft areas, and we may not provide delivery guarantees or shipping insurance there; orders may be at your own risk.

7.5 Risk of Loss and Carrier Errors

We are not liable for lost or stolen packages where:

  • The carrier or postal service makes an error;
  • You provide an incorrect or incomplete address or unit number;
  • A package is stolen after delivery to the address provided;
  • A package is held or seized by the postal facility.

Once a package is marked as “Delivered” by the carrier, the risk of loss passes to you.

8. Returns, Refunds and Product Issues

Our general rule is that all sales are final and we do not accept returns or provide refunds, subject to the limited exceptions below.

8.1 Defective or Damaged Products

If you receive a defective or damaged product, you must contact us within 24 hours of receiving your order and provide:

  • Your order number
  • The product name
  • A description of the issue
  • Clear photos or videos with the vacuum bag still attached where required

If we verify the issue and cannot troubleshoot it, we may, at our discretion, offer either:

  • A replacement product, or
  • A credit to your account (e.g., loyalty points or discount on your next order).

8.2 Product Quality Concerns

If you feel a product does not meet expected quality standards, please contact us within 24 hours with:

  • Order number
  • Product name
  • Description of the quality issue
  • Supporting photos or videos

At our discretion, we may offer a discount on a future order or a credit to your account. We do not guarantee refunds.

9. Prohibited Uses

You agree not to:

  • Purchase on behalf of anyone under 19 or share products with minors;
  • Use the Site for any illegal or unauthorized purpose;
  • Attempt to bypass age verification or security measures;

10. Disclaimer of Warranties

11. Limitation of Liability

To the maximum extent permitted by law, GasDank, its owners, employees and agents will not be liable for any:

  • Indirect, incidental, special, consequential or punitive damages, or
  • Loss of profits, revenue, data or goodwill

arising out of or related to your use of the Site or purchase/use of our products, even if we have been advised of the possibility of such damages.

In all cases, our total liability to you for any claim will not exceed the total amount you paid to us for the order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless GasDank and its affiliates, employees and agents from any claims, losses, damages, liabilities and expenses (including legal fees) arising out of your:

  • Violation of these Terms or applicable laws;
  • Misuse of the Site or Services;
  • Purchase, possession or use of our products.

13. Changes to the Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site and Services after such changes constitutes your acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
